Legal Question in Family Law in California

Ex Moving Children

My wife and I have been legally separated since October 31, 2008. The divorce is not yet final. We have joint legal and physical custody.

She just told me that she plans on moving our two daughters to a new city, 3 hours away from me and the rest of their family.

Can she do this? Also, she is refusing to provide me the name of the male she will be moving in with. Does she have to provide his name considering my kids will be living there?

Re: Ex Moving Children

You should file an OSC to prevent the move. You should also request an order that she must provide the name of the man she is moving in with. The court will be concerned if she refuses to provide the identity of this man. That information is needed to insure that he does not create a risk to the children.
