Moving to Hawaii

My Fiance has a two year old daughter, it which the father chose not to have his name on the birth certificate, and has not offered any financial obilgation, except around the childs birthday and Christmas when he feels like being a father. My question is after me and the childs mother are married in December will there be any legal repercusions, if she moves the child to Hawaii with out first notifying him. I am currently in the military stationed in Hawaii, and plan on adopting the child at the soonest possible time.

Moving to Hawaii without either his agreement or a court order could result in the court ordering her to return the child to California. You should consult with an attorney regarding obtaining an order allowing the move. He may be willing to relinquish his parental rights to avoid the payment of child support. The threat of taking his money for child support can often motivate a father in his position to relinquish parental rights.
