Legal Question in Family Law in California

Moving out of the home

My wife has asked me to leave, pending filing for divorce. A friend said his lawyer said not to until getting a lawyer and becomming ''legally seperated,'' due to abandonment issues. I.e. I could jepordize title to my home (bought before the marriage, I'm sole owner,) and jepordize child custody rights. If I leave at my wifes request, is this true?

You will not jeapardize the rights to ownership of your home. The remainder is true. Get an attorney before moving. Good Luck, Pat McCrary

I think your friend is mis-informed. Instead of getting legal advice from a friend who got the advise from someone else, I suggest that you personally consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

You will find some valuable information on various family law issues at my web site.

Good luck to you!
