Legal Question in Family Law in California

Moving 1 hour away - part 2

With regards to my previous question - Moving 1 hour away - although I understand it's always best to try and work it out with the parent, the other parent is not willing to work it out. He has stated he will take me to court and fight me within every inch of his body to keep me from moving 1-hour away. Again, he would rather his girlfriend take care of my daughter - NOT HIM - and make me stay 30 minutes away. Than just letting me move 1-hour away where I could care for our daughter more.

If he were to take me to court, would they say that it's in my daughters best interest that I work more hours and leave my daughter with her father's girlfriend - not him - rather than move 1-hour away and be able to spend that additional time with my daughter. The father would only have to give up a 2-hour visit on Mondays. He would still get her on his weekends and all of her vacation times.

Re: Moving 1 hour away - part 2

Generally it's in your daugher's best interest to have frequent and continueous contact with both parents. If you move it will interfere with her visits with her father. That's not a good thing. I am not sure how the court will rule in your specific case, that depends on a lot of things that cannot be covered here.
