Legal Question in Family Law in California

moving out of state

We have joint custody of our 14 year old daughter. She lives with me. Because of financial reasons, my husband and I are moving out of state. My daughter is all in for it and wants to go(we live in California, moving to Texas).We can not financially survive here(recently had a bankrupcty, currently past due in mortage, preforeclosure, I even had my car repo'ed yesterday!!). We are selling our house in California and will buy in cash a house in San Antonio because of our equity! This is an awesome opportunity for us financially as for a house. Because of our credit we cant even rent here after we seel, let alone pay rent here. Can my daughters father fight for us to stay in california!

(they recently moved 3 hrs away without consulting us at all because it fincially benefited them).

The best approach is to work out an agreement with him to allow you to move. That is arrange for him to have some visitation. If you move without an agreement you may be forced to return to California pending a court order for custody and visitation.
