Legal Question in Family Law in California
Moving out of state
I have joint legal custody with primary residency with mother. His visitations are 3 weekends in a row on rotating basis. I want to move to Texas to be with my Husband. Can the kids father keep me from moving?

Re: Moving out of state
The court cannot stop you from moving, but can stop removing the child from the state. You should attempt work out an alternative visitation schedule with the father. Also consider high speed internet with a web camera at each end that would allow father and child to have regular face to face contact. You could also offer him visitation during vacation time. Transportation will also be a major issue. Consider how much you can contribute to reduce his costs for transportation. If you cannot enter into an agreement then file a petition with the court.
