Legal Question in Family Law in California

Moving out of State will i be able to go

My Question Is. I have 2 children and 1 is from my ex husband which we were divorced years before are son was ever born.We have been going to court since 1999. Orders were put into place for Custody and Visitation. Myself and my Ex have Joint Legal and Physical Custody. And I (the mother) has Primary Physical Custody of are son. The courts ordered him visitation rights. So he has 2nd and 4th weekends a month and on Hoildays we each get half of the day. Here recently my Husband passed away and so it's just myself and my 2 children. The children see my mom and dad everyday because being in the same town.I'm wanting to move out of state and my parents the children's grandparents are going with us. I'm am willing to give the whole summer vacation to my Ex for vacation and Christmas any other year. I need to go to another state where i can afford to live plus my parents are moving and my children need them. With me lossing my husband resently. Me and the kids need to be with my family. So im planning on moving soon. Do you think im going to have a problem doing this. This move would be the best for the children i think. And I would be very good about the vacation after i move. Would u please let me know what you think. Thank you

You will need the permission of the father or court to move. You should begin this process immediately as it could take months. I would suggest that you get an attorney. The Supreme Court made a decision last week that will make getting permission for a move from the court more difficult. Good Luck, Pat McCrary
