Legal Question in Family Law in California

Moving...

I have a 5 yr old daughter, her father and I have a court ordered visitation. He has not seen her in a year and a half. I would like to move out of state. Is there a point where the court order is no longer valid? Can I move out of state? He also has not helped financially. I would like to move and give my children a much better life. I currently live in California. Please help.

A court order never expires with the passage of time. There's a chance that you could move out of state, and he could run to court and the judge would order you to bring the daughter back, even if temporarily, if ultimately the judge decided that you could move.

You should file an Order to Show Cause to move away. Get an attorney to help you with this one because there are certain facts you want to ensure that are in the OSC to show the judge grounds for moving away.
