Legal Question in Family Law in California

MSA Revision and default entry

I'm really lost now. I discovered an entry of default was filed due to my attorney not properly file paperwork or responding to the disclosures filed by my husbands attorney. The divorce deree is filed and was sent to my attorney on Nov. 6 2008 yet she still has not contacted me. This was my second atorney and I orginally filed for divorce in August 2006. How could I get two bad attorneys for a divorce case? What can I do. The settlement is so un even there was also the issue of alimony and child support but now our child turned 18in October of 08. Can I not get back child support? What about alimony. The judge has said in the begining I clearly would recieve it and told his attorney to come up with an amount. Now I get nothing, no notifaction of any kind from any one. I discovered the default being entered due to a friend at the court house. This is an injustice how un fair to me, I need advice .

Re: MSA Revision and default entry

If you have a default on your MSa you will be bound by it unless you act immediately. If you do not consent to the terms of the MSA as drafted then you shoould file a set aside of the judgment immediately. Your case requires immediate attention.

As always please consult with an attorney before taking any legal steps.

Good luck.
