Legal Question in Family Law in California

Multiple Wage Garnishments

I have filed a wage assignment for child support against my ex-husband. My ex-husband's other wife has also filed a wage assignment for spousal support, but they have no children. Does one wage assignment have priority over the other? How can I ensure that my kids get the support they need before the other ex-wife gets her alimony?

Re: Multiple Wage Garnishments

Both assignments have same priority. Have no fear, however, his wages can be attached up to 60% of his net, and sometimes even more. So both of you should get paid. What you do not want to do is to go to court and seek a modification as that could result in the court considering what his ex-wife is getting and cause the amount you receive to be reduced.
