Legal Question in Family Law in California
hello, i am named as the father on the birth certificate of my non biological daughter...i have recently split from her mother but dont want to loose my little girl(i'm the only father she has ever known) and the biological father has never ever been in the picture...please help what are my rights? also is it possible to sue for custody being that her mother is mentally unstable as well as abusive and it can be proven...i'm in dire need of your help

My first question to you is how old is the child. The reason for this question, is that generally, a person has up to two (2) years to set aside a Declaration of Paternity. As of this juncture, you are her father as a matter of law. Accordingly, you may sue for custody and visitation.
