Legal Question in Family Law in California

my nephew is 13 years old, his parents are on drugs and probation he is with us now and wants to stay with us and go to school. He and his parents live in Nevada, we live in California. Can he stay with us if that is what he wants? against his fathers wishes?

You need to meet with an attorney who has more time to go in depth with you about your situation. If you pursue this and do not prevail, you could be cut off from your nephew. If your chances are not good right now, you may want to wait and in the meantime have as much contact as you can to give him some stability. If his parents end up in trouble and incarcerated, which happens a lot with drug addicts, he may end up with you in the long run without the battle. You need to get more in depth, however, than this forum allows.
