Legal Question in Family Law in California
Newborn tested ''+'' mom didnt
My sister had a baby 2 days ago at pacific hosp in long beach , ca. The baby was tested for drugs and was positive for some kind of narcotic, my sister was immediately tested but she returned a negative result. This morning social services removed the 2 kids that were home with dad and now she cant leave the hosp. With the baby. She is on federal paarole and also tested the day before birth and returned a negative result as she did at the hosp. Does she have anylegal recourse to back her up? If tested again she will still be negative. We believe that either he (baby) was either affected at the hosp by staff or someone has made a serious mistake. What do we do?

Re: Newborn tested ''+'' mom didnt
She needs to retain an attorney with experience in juvenile court dependency hearings. she will also need an expert witness to testify regarding the narcotic detected in the newborn. The appointed attorneys have a very case load and often do not fully investigate a case, and generally recommend submission of the case. The baby is under age 3 the parents have only 6 months to reunify with the baby or she will be freed from parental control and placed for adoption.
