Legal Question in Family Law in California

newly widowed stepmom's rights of guardianship

How do I go about ensuring that my wife

will become the legal guardian of my

children, 10, 14, (they have very little

contact with their biological mom, who

lost all of her custody rights due to

alcoholism and moved out of state) who

have lived with us for the last five years-

(the three years before that I was a single

dad) in the event I die?

Your wife may want to consider a step-parent adoption. Then she would have parental rights in the event of your death or should you divorce. The consent of the biological parent may be sought or you can seek a formal termination of her parental rights. You should both consult with an attorney in that the paperwork can be daunting.
