Legal Question in Family Law in California
As far as I know, if the non custodial parent has deliquent child support, the non custodial parent cannot claim the child for tax examption even if family law court ordered "release a child tax exemption to non custodial parent" becasue the court did not know at the time of making the order many years ago that there is currently deliquent child support.
If I am wrong, please let me know. I would appreciate if you could point which family law or tax law code section will support above. This question may be related to tax law and family law both.
