Legal Question in Family Law in California

non payment of many years court ordered support

Two sons, who are both over 18. Court ordered child support over 15 years ago, and has just recently the case was transferred to Ridgecrest ca. The father who lives in Nevada, has evaded payments for many years. He has been awarded permanent disability payments for 5 to 6 years. The Dr. gave him 5 years if he didnt take care of himself. Are the two boys entitled to a lump sum of cash through his ssi payments? If yes, How or what do I file in order to pursue this. The kern county District attorney called, and put this thought into my head, but said she could not help me with the case. Just a little hint, she said.

When father is on social security disability the children are entitled to receive their own benefits. However, father may apply for and receive these benefits. You should apply with social security benefits for you children and see what happens. If he has received the benefits then report this to Social Security and request that they recover the children's benefits.
