Legal Question in Family Law in California
non-biological parent adoption
natural father has not visited child in 1 year. never paid child support but
signed birth certificate. mother has sole custody. natural father in jail for
murder trial. may already have felony on his record. what are the
qualifications for ''unfit'' parent? mother has a felony on record from 7 years
ago for having stolen property. will that affect the outcome? we are getting
married this year and i would like to adopt the child since i will be the sole
supporter. do i have enough reason to adopt and take away his paternal
rights?

Re: non-biological parent adoption
A prima facia case for termination of the father's rights would be no contact and no support for one year. You can terminate his rights and then adopt the child. Good Luck, Pat McCrary
