Non-biological parents rights
Does a women who is not the biological mother of a child have any rights to the child if she has been raising the child since infantcy? The father has been accused by the daughter of touching her, the child was removed and placed in foster care. The biological mother moved away shortly after the childs birth and lives in S. America in a very rural place. She has not seen or spoken to the child in almost 4 years. What rights will the mother have in getting her back.

You should petition the juvenile court to be determined to be the presumptive mother of the children. As the presumptive mother you would be entitled to all of the rights of the mother. You will not get the children back into your home until you can convince the department of social services that he will not have any unauthorized contact with the child.
