How does a non-custodial parent gain access to child's school records?

My husband has gained full legal and physical custody of our 4 year old son and has lead me to believe that I have no rights to medical or school records. I have learned that because my parental rights have never been terminated, that I do have rights. My son has shown up in the past 2 weeks with a black eye, and then a bruised and scraped back. He has been telling me for months that the boys at school have been beating him up and this is how he hurt his back. He is in preschool, and my husband has allerted the school not to talk to me. I need to know my rights and laws re this sort of thing, so that I can get answers to why my son is being battered in school.

Reply: How does a non-custodial parent gain access to child's school records?

Family Code Section 3025 (Parental access to records) states as follows:

"Notwithstanding any other provision of law, access to records and information pertaining to a minor child, including, but not limited to, medical, dental, and school records, shall not be denied to a parent because that parent is not the child's custodial parent."

Take a copy with you to the school and ask them to comply by providing you with the same information that they provide to the other parent.
