non-participent fathers

If a child's father claims the child is not his and doesn't get a paternity test and doesn't visit the child except for three times in the child's six living years what can the mother do? Will a judge grant the mother sole custody if both parents have joint legal custody right at the present time and will he/she take away the fathers parental rights at the mother's request?

The question is confusing. How did the father get joint legal custody in the first place? Judges do not take away parental rights except under the most extreme cases.
