Legal Question in Family Law in California
notifying non-custodial parent of out of pocket expenses
my ex is threatening to sue me for supposed out of pocket medical expenses that I have never been made aware of or asked for. She has never complied with the guidelines of sec. 4063 of the Cal. Fam. code. Can she succeed in dropping a bomb on me after 13 years with some trumped up out of pocket expenses that were supposedly paid by her and refused by me? The law says that you have to notify the other party in not to exceed 30 days of incurring the costs. Am I in the clear or should I expect a 12th hour onslaught of bogus charges? Thanks

Re: notifying non-custodial parent of out of pocket expenses
both. you are right and expect the onslaught of bogus claims. she'll need proof that she asked you for reimbursement. i'd ask her for the proof prior to the hearing. if she refuses, then ask the judge to reject any evidence of notice because she failed to provide it to you in advance. the court will probably order her to provide you with the documents and set a new hearing date.
