Legal Question in Family Law in California

What are my obligations?

If I leave the house we are in right

now, would I be considered as

abandoning the home. What are my

legal obligations toward the house

and should I stay just to wait for the

sale of the house? He does not want

to sell the house but he has no

money to buy me out now. If he

stays and pays for all the expenses of

the house including the house

payment, will the court say that I

have abandoned the house? If and

when I decide to leave, am I still

obligated to pay for half of everything

regarding the house payment and

household expenses? Thank you so

Leaving the home will not in and of itself have an adverse affect on you. You may want to help with the mortgage payment to save the house from foreclosure, assuming that it has a positive equity. Spousal support is an issue to consider. If your income is higher than his income, you may have to pay spousal support.
