Legal Question in Family Law in California
How do I obtain my file when I fire my attorney?
I am going to have my attorney personally served with Substitution of Attorney, because she has made several costly errors that have caused the case to be drawn out longer than necessary and she has antagonized the opposing counsel to the point that we are now stalemated (after a year and one half!). I have an outstanding balance owing to my attorney, however, I am filing a fee dispute that I am fairly certain will be settled in my favor (I've obtained the court reports that prove the errors). Can I demand my client file from my attorney when I have her personally served and fired from my case?

The State Bar is on your side, and your soon to be former attorney is obligated to provide a copy of your file even if you have a past due balance.
Good luck to you!
