Legal Question in Family Law in California

Can I obtain legal visitation to my grandchild?

I have raised my grandchild for 8 years, she has recently gone back to live with her mother, the understanding I came away with was that I could have her every other week end. Now I'm being asked to call and make plans. Do I have any legal rights to a scheduled visitation?

Re: Can I obtain legal visitation to my grandchild?

Grandparent rights have been severely limited by the U.S. Supreme Court. If you are being allowed to see your grandchild, under any circumstances, your chance of prevailing in court and getting court ordered visitation is unlikely. My advice is to take what you can get, you're unlikely to get much more in court. However, this does depend upon the individual judge. Good Luck, Pat McCrary
