How do you Obtain Sole custody when you haven't seen the father since conception

At this time, I am planing on immigrating to another country. They require a ''letter'' from my childs father stating that I have permission to travel and reside outside the usa with her. Um ok, that poses a problem. Her father has not been involved ut in her life since the day of conception. The DA at one point did try to locate him, for child support issues when she was first born. They couldn't locate said father. The child bares my last name, but her fathers name on her Birth Certificate. So they now tell me to resolve this matter i need to file for custody. HOW do I even begin, I have 5 months before I need to return to my non us home. Do I need an attorney? can I file the papers my self? I just need some questions answer that no Attorney is willing to answer unless I drag myself in. I am tired of consoltations. I just need answers.

You can obtain a court order to have him served by publication in a local newspaper. Publication takes 30 days and then he has 30 days in which file his response. You should consider hirering an attorney to assist you in this matter.
