obtaining guardianship of my grandchildren

My 40 year old daughter is using drugs with her friends in her rented apartment. I have been helping her with rent and utilities many times. Her friends stole her car and after she told me that she was willing to change I helped her again. But, she is getting worse. My grandchildren have been with me for the Christmas holidays (2 weeks) and the oldest (17 yrs old) has been living with me because my daughter doesn't want her. We live in Riverside, California. CPS has been contacted but they have not obligated her to drug test. They recommended that I file for guardianship with the probate court. But, that takes more money than what I have right now. I don't want to take the kids back to her. What is the best way to start the process to keep the children with me until she makes an effort to get off drugs?

Contact the local bar association regarding an association that provides legal assistance for children in guardianship cases. This organization would provide free legal assistance in obtaining a guardianship.

You should file for guardianship as if you were experienced in these matters, you would not want your family to have to go through the Juvenile Court System. Contact me directly.

You don't have any other options. As long as you don't have legal guardianship, she can come back and get the kids any time she wants until social services steps in and takes them away from her. If they do that, hopefully they will place the children with you. Until then, either file for guardianship or keep your fingers crossed.
