Obtaining a Passport

My ex and I share legal custody of our 9 year old son. I want to take him on vacation to Europe and need to get a passport for him but his father will not sign for it. What can I do? Can he stop me from taking my son to Europe before my son turns 14 years old, because I understand that I do not need his signature at 14?

You may need a court order, depending upon the specific language contained in your underlying Judgment and related custody orders.

You will need to file a motion. A trip to Europe would certainly be in the child's educational interest. Mention to your ex that it may be embarassing for him to explain to the court why this would not be good for his son. I can't see a judge denying your request. Good Luck, Pat McCrary

Based on your son's father's behavior, it appears you will need to contact the court to request permission. I do not believe the court will deny your son.
