Legal Question in Family Law in California
Obtaining Sole Custody
My spouse kicked myself and my children out of our home 10 months ago and I am now filing for divorce, my lawyers have told me that I will obtain primary physical custody of my children, but for many reason I feel that it is best if I fight for sole custody; My ex husband is a pervert and had a habit of watching pornography with my youngest daughter in the room ( I did not know this while it was happening) is this a good reason to file for sole custody?, would a judge look negatively on this?

Re: Obtaining Sole Custody
It depends on different facts that are presented here. Maybe you should ask your attorney's about monitored visitation and/or a 730 evaluation.
Re: Obtaining Sole Custody
Anything you allege in Court will require that you provide proof to the Court of your allegations. Sole physical custody is tough. The Courts want both parents to have contact with the kids. Talk to your attorneys.
