Legal Question in Family Law in California
I am in an ongoing custody battle with my ex and in Jan. 2011 the judge ordered a psychiatric evaluation. The evaluation came in in July. 2011 now we are waiting to go back to court for a hearing because he appealed the order. During the times that my ex has taken our kids, my kids come back very different, they have attitudes and question me on where their child support goes. They even tell me that I am mean because I am taking their dad's money. He puts them against me constantly and sends me harassing text messages and threatening messages through our children. What can I do to stop this. If I put a restraining order on him, will it hurt my custody case? Or is it best to file a temporary order for visitation? Please help me.

The way your question is asked shows you know too little about Family Law to even ask a question that makes sense to answer. I don't say that to be critical, but just to tell you that you are in over your head in this. I COMPLETELY understand the issues you are facing and they are very real. But it is too much to ask to explain it all to you to rephrase your question and then answer it. You need to talk to a local attorney in your county.
