Re: Online Business & Divorce
It depends on how valuable the business is. If you are the sole employee of the business, then the business does not have much value because the value is solely based upon your efforts. The business loses its value once it loses you, and you can quit any time you choose. It is more likely in your situation that instead of valuing the business, the court would value your earning capacity and award spousal support based upon your earnings in comparison to your spouse's earings. If, on the other hand you have a huge operation, then one-half the value that the business will sell for is what you will have to pay your wife to put the business in your name, but this is also what your wife would have to pay you to put the business solely in her name, or you could sell the business, split the proceeds, and then start a new business, fresh.
