Can an open divorce case be moved to another state

My wife and I have been seperated for over 2 1/2 years, she filed for divorce in CA where we resided for 11 years, since the seperation we both have moved out of state and the case remains open, we were married in Florida I live in Florida now and she lives in VA ... can we move the divorce to either state?

You would have to dismiss the California case and file in your present state.

You can dismiss the case in California and then file in the state that either of you live. However, it would be easy to complete your dissolution here in California and could be complete within a couple of monthe, depending on the county. It is also probable that neither would need to appear in court. It might be cheaper to finish that way as opposed to filing a brand new dissolution. Good Luck, Pat McCrary
