Opposite sex step children sharing a bedroom
While my 9 yr old son goes to his dad's home on the weekends for visitation, he shares a bedroom with a 10 yr old stepsister. My ex-husband remarried two years ago and his current wife brought two daughters in the marriage. They also now have a 1 year old son together for a total of four children. They own a four bedroom house. The eldest step daughter (12) has her own room, my 9 year old and the second stepdaughter (11) share a room with bunkbeds and the 1 yr old son sleeps in the parents room. This sleeping arrangement has been in place for about a year and half now since they purchased the home they now live in. I have asked my ex-husband several times to reconsider the sleeping arrangements in his home, yet there has been no change and I do not believe that there will be. My son has expressed to me that he does not like this arrangement and and I do not feel that it is appropriate. Are there any laws in California that address this particular type of situation?

There is no specific law for this case, however, child custody orders are made based upon the best interest of the child. This does not seem appropriate to me. You can file a motion to modify the child sharing schedule so that there are no overnight visits unless father has appropriate sleeping arrangements. I would suggest that you file the motions as fathe will probably not make any changes unless he may lose custody rights. Good Luck, Pat McCrary
