Opposition to Petition for Name Change
I have a one year old son who has only seen his father a handful of times. When my son was born, his father and I agreed that his name would not be on the birth certificate because I needed to get Medi-cal for our son and he didn't want the state to come after him for money. We agreed that our son would have my last name. Since, his father has married another woman, and now he wants my sons name changed to his last name. I have been told that the court will probably allow this, or at least to have his name hyphenated, but he will have to pay for it. Where in the law is it written that a child must have their father's last name? What can I do to make sure that my son gets to keep my name?

You will both get your wish on this, kind of. The court would probably order the child to have a hyphenated last name, containing both of your surnames.
