Legal Question in Family Law in California

What is the order in which the divorce paperwork goes in? The "summons-family law" has been filed, the "petition", has been, too. So has the "Declaration-Uniform custody minor" (there is a 5 year old child involved). And there was an "order-waiver of fees and costs" filed, as well. I have all the paperwork. Does it all get turned in at once or what? Does the petitioner HAVE to be at the courthouse for the hearings, if they are in a treatment program?

All of the documents you mentioned can be filed at the same time. The fee waiver is not served on the respondent. The petitioner does not need to be present at court when the papers are filed. You mentioned petitioner being in a treatment program. If that program affects the petitioner's ability to make decisions, such a signing a contract, then the petition may not be valid.
