Legal Question in Family Law in California

Order to Show Cause for Child Support Modification

In Oct. 99, a judge order my child support according to the California Guidelines for one child at $690 based only on the information the spouse gave. The information was not correct.

I was told by the San Bernardino Court I needed to file a OSC rather that a Motion as that court would just throw it out. I believe the form I want to use is the 1285 OSC for Modification but unsure about the response form for the spouse. I have proof that her figures were not correct and want to file a civil subpena to obtain the records.

The court told me I had to do this myself and have it notarized. The form that I have is the 982a 15.1 which is the Civil Subpoena (Duces Tecum) for Personal Appearance and Production of Document and Things at Trial or Hearing and Declaration.

I just need to know if the forms I am using are correct for this, if not what forms do need.

To figure out which forms you need you should consult a book on how to handle your case. Nolo press makes a good one which may be available at you local library or at a law library near you.
