Legal Question in Family Law in California

order to show cause contempt of court for non support

I have recieved an ''order to show cause affidavit for contempt'' because I have not been able to find a job in the last year and have paid no child support. Let me add that this is back support the kids are now 23 and 24 years old.I have hand delivered, E-mailed, and faxed approx. 15 resumes in the past 12 mos. I have had 4 interviews and still no job. What else does the court want me to do? I am 54 years old and have a total work history of 5 years. My whole life has been a stay at home mom. ( I have raised 2 other kids from prev. marriage) What can I expect the court is going to do? Put me in Jail? What info. do I need to take with me?

Re: order to show cause contempt of court for non support

You should show up at the hearing and ask the court to appoint an attorney to represent you. Do not file any declarations, do not say anything at the hearing other than to request an attorney. Do not try to explain your situation or take any documents with you. Do not discuss the case with anyone. You can assume that anything that you say will be used against you. When you have had the attorney appointed you can then tell him your situation and he can give you advice. If found guilty, you could be put in jail or ordered to do public service and also ordered to pay attorneys fees and a fine. Good Luck, Pat McCrary

Re: order to show cause contempt of court for non support

First request an attorney. The court will appoint an attorney to represent you in the contempt matter. Judges usually like to see at least one interview per week. Get the name of each person you have an interview with and date and time of the interview.

Your court appointed attorney can fill you in on what the local court wants in the way of work efforts.

The first order that the court will make after the appointment of an attorney, will be a work efforts order, unless it has already made such an order.

Get an attorney, the court will give you one on a contempt matter. Have him get things assembled .

The court will probably appoint an attorney to represent you, perhaps at no charge to you. Lack of ability to comply with the court order is a possible defense to the contempt citation.

Good luck to you.
