Legal Question in Family Law in California

Order to Show Cause

My first question is: I want to know what is the first thing I need to do to get to visit my kid. His mom and I are not together. If I submit an order to show cause how long will it take for all the process to be over(approximately)?

Re: Order to Show Cause

You need to file a petition for determination of parentage, and at the same time, file an order to show cause for visitation. You can always file "ex parte" for custody and visitation, not so that you can get custody, but so that too much time doesn't pass before you can get into court. Some courts, it can take 2 months to finally get a hearing. If you file it on an ex parte basis, you can get in within 24 hours.

Re: Order to Show Cause

An order to show cause is given a hearing date usually about 30 to 40 days from the date of filing. Have good reasons to ask for the Court's help. Get visitation orders from the Judge at the hearing.
