Legal Question in Family Law in California

Order to Show Cause; Supporting Declaration and Documentation required

My ex-husband served me with an Order to Show Cause for Reimbursement of Medical and Educational Costs for $ 7,000. He did not attach any supporting documentation or explain on the form how he came up with that amount and/or for what medical/educational costs he wanted reimbursement. On the form he indicated he would bring ''an accounting'' to the court hearing. I checked the entire Family Code and cannot find the part about him being required to provide that information to me before the hearing so I could respond/reply. Isn't his request deficient if he does not provide justification for the amount he wants reimbursement?

Re: Order to Show Cause; Supporting Declaration and Documentation required

You are correct you must be served with the documents prior to the court hearing. Also, if there is not court order for educational expenses he cannot obtain reimbursement on those amounts. Good Luck, Pat McCrary
