Legal Question in Family Law in California

i am being ordered to pay child support on a child i dont belive is mine, this is without a patternety test. if i give up parental rights will i still will owe child support?

Yes. You cannot give up paternity rights. They belong to the child, not to you. They can only be taken away on the child's behalf when absolutely necessary for the good of the child, or in the case of adoption when there will be a new parent. The only way out of supporting this child is to obtain a judgment that you are not the father.

We get this question a lot. There is no way to give up your parental rights. Agreements between parents to forego child support are unenforceable. You need to challenge paternity if you don't want to pay support.
