Legal Question in Family Law in California

I'm ordered to pay my ex-wife spousal support which is deducted from my weekly paycheck. I work for a contractor and will be laid off for a week or two at the end of the year. What do I have to do to prevent this from becoming an issue? I won't have a paycheck for them to take out the support, so what do I do?

I recommend that you contact your former wife or her attorney and request a temporary modification of the support order for the months that you will have reduced income. I recommend negotiating an adjustment to increase the subsequent payments to make up the difference between what you should be paying and what you are actually able to pay. If you qualify for unemployment during these weeks, I would negotiate a smaller payment of spousal support from these resources.

If negotiations do not work, you may need to file a request for modification of the support order in court as a way to get your former spouse to the negotiating table.
