Legal Question in Family Law in California

OSC- Change in Visitation

Thank you in advance for your advice.

I am the custodial parent for my son, who is 33 months. Current visitation is as follows: Every Wednesday at 11:00am to Friday at 11:00am, because these were his days off from work.

His Father recently was fired from his job, and is now working for his family. His current days off are the weekend. He has filed to change the visitation to EVERY weekend, stating in his OSC that because I stay at home with my two boys then he should get what ever days he wants. Is this something that will most likely be granted to him?

I feel that it is unfair, my son will be starting school soon, so that would mean that I only see him after school and never be allowed weekends with him. In the paper work that he served me with he states, ''i understand that she will not be able to make plans, go on trips, ect. on the weekends with her husband and son, but that is not my problem'' Should I get an attorney to fight this or will the court most likely order every other weekend with a midweek dinner?

Re: OSC- Change in Visitation

You can have one schedule now and one when you child gets in school so that you will have non-school time with him. Good Luck, Pat McCrary
