OSC-Modification

My ex-wife and I agreed to several terms during our divorce. I agreed to joint legal custody and she would have physical. I would have my two girls 15% and she will have them the other 85% of the time. I currently have my girls every tuesday night (already 15% of the time) plus every 3rd weekend. She filed a OSC-Modification to request I have the girls every other weekend. Does this give me grounds to request less Child Support payments given the fact that I already have them more than 15% of the time and this change will increase that to 35%???

Yes you can request a modification of child support based upon the increase in time with your girls. However, you should have your guideline childsupport calculated by an attorney who practices in the court where you would file the motion. I have witnessed many times when an unsuspecting parent received an increase in support when they were asking for a decrease. Good Luck, Pat McCrary
