Legal Question in Family Law in California

The other parent and myself established a 50/50 custody between us through the court system and the mother and father agreed to sign a stipulation to give up her nights due to a situation that she was in that has been resolved for about a year now. I need to know now how to go about getting my full 50% custody back and having the stipulation dropped. As i said earlier this was a mutual agreement between both parents and was not done in front of a judge.

You need to return to court to request that the current court order be changed.

Whatever the court order says that is signed by a judge is the controlling order, but if the custody arrangement has been changed for some time, be prepared for an ex parte. You should speak to an attorney in your area about how to proceed. For further information, visit www.ellifritzlaw.com
