There is no age when the child can make his/her own decision. The court always has jurisdiction to make the decision in the best interest of the child. The court must consider the child's desires, however, weighs in other factors, the most important of which is age of the child. A three year old's stated desire would hvae little weight. A twelve year old's will be given strong consideration. A sixteen year old will pretty much state where they want to live. There are other considerations, however, that is how age factors into the consideration. Good Luck, Pat McCrary
