Legal Question in Family Law in California
Help
The other parent lied, the judge believed them, now I have the proof. We are going on a modification and it is a new judge. My question is how much weight will the previous judge's opions of me be on the new judge? also can I now present the evidence that shows the lies? Also the other parent wrote a letter to kill another person then commited suicide to me, can I represent this to the new judge? I don't have an attorney the other side does. I have sole physical and the other parent is seeking sole physical and sole legal and supervised visitations for me for no reason. They also want a phys. eval. The mediatior is not recommending one. Thank you

Re: Help
No one but the new judge can answer that question as to how much or how little the opinion of the prior judge will affect him or her. The custody and welfare of your children is at stake, you should either retain an attorney to represent you or do a tremendous amount of research to learn the rules of evidence and the factors considered in a custody and visitation decision by the court. Evidence can generally be introduced for the purpose of impeaching, showing that the party is nto honest with the court.
