Can a parent sue a non custodial parent for reimbursement of out of pocket medical expenses, if they are not utilizing the medical insurance provided by the non custodial parent.

If the non-custodial parent has been ordered to provide the insurance as part of a custody and support order, the custodial parent can only collect for non-covered expenses such as deductibles, co-pays, and non-covered care. If the coverage was not addressed in the custody and support order it gets a LOT more complicated.
