Legal Question in Family Law in California

what to do if parent has suspended drivers license?

Father of my son has lost his drivers license due to a dui, he lives out of town, and I am required to meet him at a half way point to give him visitation. Do I have to continue to let my son ride in a car with his dad who does not have a license? If not do I need to go back to court to get this changed or can I just stop taking him with out getting in trouble.

Re: what to do if parent has suspended drivers license?

You should first ask him about the status of his driver's license and then request that he have someone drive him to and from the meeting for the exchange. If he does not agree then you should petition the court for an order that he not drive without a valid drivers license.

If the father is driving without a license then he is also driving without insurance. If he will not voluntarily desist, thwen it is incumbant on you to get a court order to prevent him driving with the child. It's always better to agree if you can!
