Legal Question in Family Law in California
parental custody
At what extreme do you limit custody of your children to their father. After 10 years of marraige/parenting the father is using drugs(at one time speed and known pot) and drinking tequila heavily. He has been gone 16 months, helping to pay bills until 6 months ago. Not seeing the children but maybe 10-12 hours a month if that. Calling maybe 4 times a month. The children long for their fathers' visits. But for their safety I feel after speaking to an attorney I need supervised visits until drug and alcohol therapy, and even possibly parenting classes. I tend to agree, although I don't want to be unfair or mean... I also want to protect my children. Am I unreasonable or is there any other way to not be so harsh yet firm in this matter. I don't trust his word not to smoke pot or drink (even beer) while he has them, as partying seems to be more important to him obviously.

Nothing will change unless you file an OSC
Re: parental custody
There are only two choices supervised or unsupervised visitation. You may be able to make the supervision less disagreeble by selecting a family member or someothe such person as the supervisor. The safety of your children must take presidence over how he may feel.
