Legal Question in Family Law in California

Parental Responsibility

Is there a way to remove ourselves from legal responsibility for our 17 year old son. We have no authority with him in our home. He wants to leave and we are happy with that decision. Do we need some protection under the law.

Re: Parental Responsibility

You really cannot. The juvenile court can remove him from the home if you are unable to control him or if he is determined to be in some sort of danger. You really can't lock him out of the house unless you want to be seen as putting him in danger and then child protective services can remove him from the home, and place him in foster care or remand him to your house. I have encountered many parents with this type of dilemma and it is unfortunate. The parent is stuck with the child and the child is stuck with the parent. If he petitions the court for emancipation, then the court can declare him to be emancipated prior to him turning 18. Feel free to contact me with further questions-Martin
