Legal Question in Family Law in California
Parental responsiblilty/minor child
My daughter is a single mother and has to relocate (124 miles) for financial reasons. She has a minor child (daughter age 17) who refuses to relocate with her and says that she (her mother) can't force her to go with her. Can she legally force her to go even if she refuses ? She's incorrigible. What are my daughter's responiblilties if she can't get her daughter to move?
thanks...

NOW, IN RESPONSE TO YOUR INQUIRY --
The facts that you have provided are not clear
enough and/or complete enough to provide a
definitive answer to you inquiry; however, I would
say: if your daughter has custody of your grand daughter (i.e., the father is not in the picture), your daughter legally can "force" your grand daughter to relocate (assuming no child abuse occurs in the process). She also could go to court and try to have your grand daughter emancipated if your grand daughter meets the legal requirements for doing so. If your grand daughter really is legally incorrigible, the Juvenile Court may take jurisdiction over her in a dependency action. Social Services or law enforcement usually initiates this action. Before your daughter takes any action, she should consult with a lawyer with experience and expertise in this area of law.
